| Preface: | A cardinal origin of all Yorubas had risen from its deep slumber in the sprit of oneness and positive progress. Not forgetting our origin, we have in loving accordance put aside our differences as individuals and swear to uphold the belief, norms and “ethicultural” values of the Oyo Empire. The Federation of Oyo State Student Union will leave no stone unturned in contributing our quota to the progress, unity, dignity and development of Oyo State. Hence, the enactment of the FOSSU constitutional provisions. The constitution shall be recognized, valued and identified as the constitution of the Federation of Oyo State Student Union, Lagos State College of Primary Education, Noforija, Epe, Lagos. Thus, it shall be called The FOSSU CONSTITUTION. Slogan : "Oyo o jo won." Motto : "We set the pace" |

1.2 CONSTITUTIONAL SUPREMACY 1. Our constitution shall remain supreme and its provisions shall be binding on all members of the Federation of Oyo State Student Union., 2. If any other law, directive or action is inconsistent with the provisions of this constitution this constitution shall prevail and such law, directive or action shall be null and void. 3. On no account shall this association be governed by any non-indigene except the student(s) of Oyo State. 4. This constitution shall be subjected to amendment if and when the need arises. 5. Only with the support of two-third majority shall any amendment be made. 6. Constitutionally, all FOSSU executives must be democratically elected. 1.3 MEMBERSHIP CRITERIA 1. This association is opened to all students of Oyo State in every tertiary institution of learning. 2. Interested students should register through the General Secretary and make payment to the Financial Secretary. 3. All payments are non-refundable. 4. On satisfaction of every criterion, proof of membership shall be given. 1.4 BASIS OF OPERATION All faithful members of the federation of Oyo State Student Union shall enjoy equal rights and privileges and shall perform their duties and fulfill their obligations as stipulated in this constitution by: 1. Participating actively in the activities of FOSSU. 2. Observing the resolutions and all decision regularly adopted by FOSSU. 3. Regularly paying annual subscription fee and all other dues as may be determined from time to time in accordance with the provisions of the constitution. 4. Attending all meetings/congress called by FOSSU. 5. Upholding the dignity and integrity of Oyo State as our genetic entity. 6. Strictly adhering to the provisions of the FOSSU constitution. The activities of FOSSU shall be directed such that programmes shall not be concentrated in fewer areas and any member of the association who fails to perform any of these obligations shall be given appropriate sanction. 2.1 SPONSORSHIP MATTERS Patrons/Matrons, other Sponsors and Advisers 1. The executive council shall recommend patrons, matrons, other sponsors and advisers for appointment. 2. Delegates shall also have the right to nominate patrons, matron, other sponsors and advisers for approval by the council/congress. 3. Such recommendations shall only be approved by two-third congress majority votes. 4. Principal sponsorship shall come from the patrons, matrons, advisers, FOSSU members and indigenes of Oyo state, companies and well-wishers. 5. Removal of such sponsors shall be on the recommendation of the executive council to the congress, which shall approve same by two-third majority votes. 6. The member of sponsors shall not exceed eight. 2.2 Advisers The staff adviser must also be a sponsor and may not necessarily be an indigene of Oyo State. His duties are to support the Union morally, financially and otherwise. The FOSSU legal adviser must be a legal practitioner in or outside of the college but may not necessarily to be an Oyo state indigene. 3.1 CONGRESS MATTERS The Executive Council 1. The president 2. The vice president 3. The general secretary 4. The assistant general secretary 5. The treasurer 6. The Financial Secretary 7. The Public Relations Officer 8. The Assistance Public Relations Officer 9. The Social Director 10. The Welfare Director 3.2 The FOSSU Congress The congress shall consist of the President, other principal Officers and all members of the association. The congress shall have: 1. Power to fix the date, time and venue of FOSSU’s next meeting. 2. Power to operate as provided by the constitution. 3. Power to converge at most four times monthly. 4. All these and many more only on two-third majority votes. 3.3 General Functions of the Executive Council The FOSSU executive council shall be responsible for: 1. Upholding and defending constitutional aims and objectives of the association. 2. Day-to-day administration of the association. 3. Appoint ad-hoc committees as necessary. 4. Take care of association properties. 5. Execution of programmes and policies of the association. 6. Recommending, suspending and sanctioning of any member on disciplinary grounds with two-third-majority council members or/and congress. 7. Collectively complying with decisions reached by the council and congress. 8. The financial, human and material management and resourcefulness but not directly or indirectly compromising FOSSU’s goals and aspirations. 4.1 ELECTION MATTERS Eligibility to Hold Executive Offices Only bona-fide students satisfying the academic and electoral criteria and financial obligations for application shall be eligible to contest. 4.2 The Electoral Process 1. An electoral committee shall be appointed under due process. 2. 6-member electoral committee shall conduct election. 3. It shall consist of the Chairman, Secretary as well as members from any level. 4. Voting rights shall be granted to all registered members. 5. Credible members from any level shall be eligible to contest for election into office. 6. Election shall come in open-ballot system. * Election into the Council of Executive shall be transparent, fair and democratic as possible; that a tie means re-election and contestants for such election shall obtain election forms from the Electoral Committee. 4.3 Respective Functions of Council Members a) The president shall: 1. Be the chief executive, representative and spokesman of FOSSU. 2. Co-ordinate and harmonize the activities of FOSSU and participate when necessary in the activities of member/sister associations and affiliates. 3. Through the Secretary General summon meetings of the Executive Council and the Congress. 4. Preside over all meetings of the council and shall only have a casting vote when there is a tie. 5. Direct the activities of FOSSU. 6. Be the overall custodian of FOSSU. 7. Have the power to approve or reject vouchers raised by any executive or/and members of FOSSU. 8. Be co-signatory to all accounts of FOSSU. 9. Perform or delegate after consultation with the members or the executive council. 10. Be held responsible and accountable for the discharge of delegated functions and associational actions. b) The Vice President shall: 1. Assist the president in all his duties and deputize for him fin his absence. 2. Supervise set-up committees. 3. See to the social and academic welfare of all members. 4. Be the liaison between sister associations and other organizations. 5. Perform any other duties as incidental to his/her office or as delegates by the president. c) The Secretary General shall: 1. Conduct correspondence of FOSSU in consultation with the president. 2. Implement FOSSU policies in conjunction with the president and the council. 3. Notify and summon meetings at the instance of the president’s stating agenda. 4. Keep minutes of all FOSSU meetings both executive and congress. 5. Compile with the assistance of other executive members, bi-monthly and annual reports of FOSSU activities. 6. Take care of other FOSSU secretarial duties. d) The Assistant Secretary General shall: 1. Assist the Secretary General in all his duties and deputize in his absence. 2. Be the Supervising Secretary for any established FOSSU committee. 3. Perform all such duties as delegated to him/her by the Secretary General and the President of the executive council. e) The Public Relations Officer shall: 1. Be responsible for the publicity of all FOSSU activities. 2. Serve as a link between FOSSU, other associations and the public. 3. Be responsible for the production and distribution of FOSSU publications with the assistance of the Secretary. 4. Chair FOSSU’s media enlightenment activities. f) The Assistant Public Relations Officer shall: 1. Assist the Public Relations Officer in all his duties and deputize for him in his absence. 2. Perform any other duties as incidental to his/her office and as delegates by the President and the Public Relations Officer. g) The Treasurer shall: 1. Be the financial custodian of FOSSU. 2. Collect all FOSSU dues and deposit such with FOSSU banker within seven (7) days. 3. Keep the account records. 4. Write and sign all cheques of FOSSU. 5. Be co-signatory to the FOSSU accounts. 6. Approve expenditure before the release of funds. h) The Financial Secretary Shall: 1. Keep the records of all payments made to FOSSU. 2. Issue all payment voucher, such vouchers being counter signed by the president and the treasurer. 3. Be co-signatory to all FOSSU cheques and accounts. 4. Advise the executive council on the control of expenditure. 5. Prepare, audit and present financial reports to the executives and members of the FOSSU congress on request and tenure end. 6. Transfer all dues collected to the Treasurer within forty-eight (48) hours. 7. Head the FOSSU Financial Committee i) The Social Director shall: 1. Be responsible for socio-cultural activities of the Union. 2. Be responsible for providing refreshments and recreational facilities for the use of the union. 3. Arrange and conduct all FOSSU social and educational excursion hours. 4. Chair FOSSU sports and socio-cultural committee. j) The Welfare Director shall: 1. Be responsible for the management of the union and other FOSSU student welfare services. 2. Chair the FOSSU welfare committee. 3. Attend to FOSSU welfare matters. 5.1 OFFICE MATTERS Tenure of office 1. The council of Executives shall stay in office for one academic session unless removed or resigned constitutionally. 2. On tenure completion, no member shall remain in office unless re-elected and re-assigned fin accordance with the provisions of the constitution. 3. The Executive Council members can only rule for an academic session for only two terms and if only democratically re-elected. 4. On resignation, concerned officer(s) are obligated to tender to the congress, a letter of resignation, which its content may either be accepted or rejected via the due process i.e. 2/3 majority. 5. Via Council/Congress, an executive, committee or a member may be sanctioned if a motion of “ill-activity” is raised and passed by two-third-majority votes. 6. The outgoing Council of Executives shall hand over ceremoniously to the newly elected officers at the end of their tenure. 6.1 PROPERTY MATTERS Assets of FOSSU 1. Every FOSSU official shall take care of all FOSSU properties entrusted in his/her custody otherwise be fined and charged for replacement. 2. A successor, to any office shall formally lodge complaint for any union property on record that cannot be traced within a week of assumption in office. 3. If (2) is not done, the successor will be held responsible for the loss. 7.1 FINANCIAL MATTERS This part of the constitution bothers on the income and expenditure of the Federation of Oyo State Student Union and it stipulates that: 1. The bank account of FOSSU shall be called the “FOSSU ACCOUNT”. 2. Account number may be dictated to member if considered necessary. 3. FOSSU executives and Congress members may raise funds if considered necessary. 4. On no account shall funds not belonging to FOSSU be paid into the account. 5. Signatories to the account shall include: a. The President b. The Treasurer and c. The Financial Secretary 7.2 Auditing 1. The house shall appoint two FOSSU members as Auditors to inspect the FOSSU book of account to check excesses in revenue and expenditure carried out by the executive on suspicion, allegations or/and two week to the dissolution of the Council. 2. Elected Auditors may be third party. 3. After accounts auditing, outgoing FOSSU Council should not have access to FOSSU funds. 4. In the case of fraud, a panel/committee shall recommend measures to recover misappropriated funds. 5. In this case, a law suite may be necessary. 8.1 COMMITTEE MATTERS Ad-hoc and Standing Committees The FOSSU executive council shall have the authority to establish and dissolve Ad-hoc and Standing committee on behalf of the Union and shall to a large extent determine the composition and function of such committee as the need arises. These committee include: 1. The Social Committee 2. The Finance Committee 3. The Publicity Committee 4. The Electoral Committee 5. The Academic/Tutorial Committee 6. The Disciplinary Committee 7. The Caretaker Committee in Council absence. 8. The Constitutional Drafting and Review Committee *The constitutional review committee shall comprise: a. The President b. The Executive Council and c. Elected Committee Members. 9.1 IMPEACHMENT MATTERS This section deals with the constitutional removal of any FOSSU council member if found guilty of any offence and it goes thus: 1. Whenever an allegation is passed in writing with name(s) endorsed and supported by two-third-majority of FOSSU against any FOSSU council member, then the concerned officer should be removed if found guilty. 2. If the accused officer is not found guilty, he/she will have to retain his/her office. Hence the initiator of such allegation(s) may be sanctioned. 3. Rumours and false allegation of great informality shall not be entertained. 9.2 Resignation of Officer(s) 1. Resigning officer(s) should notify the Council/Congress officially at least two weeks before resignation will take effect. 2. Every notification shall pass through the due process i.e. two-third-majority. 3. Resignation notice must be documented. 4. On no account shall any resigned member(s) play as, with or without other functioning executives unless the need arises. 10.1 CERTIFICATE OF MERIT 1. On successful tenure completion, all officers should be given merit awards for good conduct. 2. Merit certificate is also necessary for performing individual members. 3. Certificates of honour shall also be given during FOSSU socio-cultural functions. |
